What's crazy is that the lawyers are trying to fight whether Jacobson applies.... But Jacobson never justified restrictions from work and school.... Just a FINE!

It boggles my mind why this hasn't been argued.

Jacobson is the case that they use to justify bullshit but it only allowed a fine.

Please correct me if I'm wrong, but this big hole should be used instead of arguing whether a shot is effective or not πŸ™„.

So then, even if Jacobson applies to some super safe shot, only a fine is imposed for not taking it... Just like the original case said!

You're of course correct about Jacobson just requiring a fine.

(For people who want more details on this, Sujata Gibson discussed Jacobson a bit in episode 6 of the podcast, and you can see the case here: https://en.wikisource.org/wiki/Jacobson_v._Massachusetts).

However, I have a different point of view on whether it's a good idea to push for fines as an alternative to going through schools, employers, etc. The Jacobson fine was $5 in 1905 money. In 2019, NYC imposed an MMR vaccine mandate on everyone living in certain ZIP codes in Brooklyn and fined violators $1,000. Legal challenges to that mandate failed. I imagine fines could be higher and accrue interest or fees too.

I actually think it's likely that once the state and national health data infrastructure is complete (within a few years), vaccination requirements will be issued to every individual directly from health departments, with fines and restrictions imposed automatically.
